SUMMARY:
Under direction, provides wide range of legal services to the City of Evans City Council, City boards and commissions, and City departments, including drafting and reviewing resolutions, ordinances, contracts, and other legal documents.  Supports the City Attorney and prosecutes all municipal cases for the City.

ESSENTIAL FUNCTIONS: (Essential functions, as defined under the Americans with Disabilities Act, may include the following tasks, knowledge, skills and other characteristics.  The list of tasks is ILLUSTRATIVE ONLY and is not a comprehensive listing of all functions and tasks performed by positions in this class). Represents and provides legal assistance and advice to City Council, City boards, City commissions, and City departments. Prosecutes cases in municipal court. Drafts and reviews a variety of documents including but not limited to ordinances, resolutions, contracts, intergovernmental agreements, legal opinions, land use documents, leases, and staff reports. Reviews documents presented to the City by outside entities . such as contracts, leases, land use documents, and intergovernmental agreements. Conducts legal research; provides advice on a variety of legal issues; investigates and monitors claims against the City and initiates or recommends appropriate legal action. Monitors and participates in review and preparation of cases for litigation, including drafting pleadings, conducting discovery; negotiate settlement and agreements. Acquires and maintains a thorough knowledge of federal, state, and local laws, ordinances, rules, and regulations related to City operations. Interprets City charter, code, ordinances, resolutions, and City policies in response to Council direction, staff requests and citizen inquiries. Represents City Council, boards and commissions as directed by the City Council, City Manager or City Attorney. Responds to and/or coordinates responses to CORA requests. Represents the City in motions to quash subpoenas duces tecum. Drafts, updates, revises and brings municipal court standing orders into compliance with changing statutes. Provides training to various departments to avoid potential City liability in future litigation. Performs other duties as assigned.

 

REQUIREMENTS:

A Juris Doctorate degree from an accredited college or university; admitted to practice law in the State of Colorado; five years of active practice of law or three years of municipal law concentration; valid Colorado driver’s license;

knowledge of the laws, regulations, and statutes governing the practice of law in the State of Colorado and the City, including the City Charter and Code, Colorado Revised Statutes, U.S. Code, Code of Federal Regulations, Colorado case law, U.S. and Colorado Constitution, Rules of Procedures for county and district courts, State of Colorado and the 10th Circuit Federal Court; knowledge of available resources for conducting legal research including those found in hard print and via electronic mediums; knowledge of inter alia, municipal, civil, constitutional, administrative, traffic, bankruptcy, oil and gas, and criminal law and regulations; knowledge of the principles and techniques of consensus-building and conflict resolution; skill in conducting legal research and preparing legal pleadings, briefs, and opinions; skill in analyzing problems, identifying alternative solutions, projecting consequences of proposed actions and implementing recommendations in support of City goals and objectives; skill in reviewing, analyzing and preparing a wide variety of legal documents; skill in presenting cases to courts; skill in the safe and lawful operation of a motor vehicle; ability to listen well and communicate effectively verbally and in writing with various audiences;

ability to analyze problems, identify alternative solutions, and project consequences of proposed actions; ability to use standard office equipment, computer equipment and software, including word processing, presentation, data base management, spreadsheet applications and electronic mail; ability to prosecute municipal and traffic offenses, or reach plea agreements with defendants; ability to effectively monitor proposed state and federal legislation and prepare legislation impact reports; ability to present sound legal arguments on behalf of the City; ability to use independent judgment when making decisions for assigned areas; ability to negotiate resolutions to complex legal issues; ability to establish and maintain effective working relationships with employees, other agencies, vendors, and the general public.

 

Physical and Mental Requirements:

While performing the duties of this job, the employee is required to sit for prolonged periods.  The employee is regularly required to see, hear, talk, stand, reach, twist, demonstrate manual dexterity and use repetitive motions in the conduct of work.  The employee is required to exercise visual concentration for extended periods of time.  The employee is required to focus attention on tasks without losing concentration or becoming distracted by surrounding activities and interruptions.  The employee is also required to perform kneeling, squatting, stooping and pushing, pulling and lifting to 15 pounds.
